จากการศึกษา พบว่า เกิดปัญหาทางกฎหมายเกี่ยวกับระบบการบริหารจัดการอุทยานแห่งชาติในประเทศไทย 3 ประการ ได้แก่ ประการที่หนึ่ง ปัญหาทางกฎหมายเกี่ยวกับการกำหนดประเภทของเขตอุทยานแห่งชาติ ประการที่สอง ปัญหาทางกฎหมายเกี่ยวกับการกำหนดแผนงานในการบริหารจัดการอุทยานแห่งชาติ และประการที่สาม ปัญหาทางกฎหมายเกี่ยวกับการขาดการมีส่วนร่วมของประชาชนในระบบ การบริหารจัดการอุทยานแห่งชาติ ซึ่งปัญหาทางกฎหมายดังกล่าวได้ส่งผลเสียทำให้การบริหารจัดการอุทยานแห่งชาติในประเทศไทยไม่มีประสิทธิภาพ และทำให้เกิดความขัดแย้งระหว่างหน่วยงานของรัฐด้วยกันเองหรือกับประชาชน อีกทั้งไม่สามารถคุ้มครองและดูแลรักษาทรัพยากรธรรมชาติให้บรรลุเป้าหมายตามภารกิจของรัฐและเจตนารมณ์ของกฎหมายที่มุ่งประสงค์ให้มีการคุ้มครองรักษาทรัพยากรธรรมชาติให้คงอยู่ในสภาพเดิม เนื่องจากไม่มีกำหนดประเภทของเขตอุทยานแห่งชาติให้ชัดเจนเหมาะสม ไม่มีแผนงานอุทยานแห่งชาติในการบริหารจัดการที่เหมาะสมกับประเภทของเขตอุทยานแห่งชาติอย่างชัดเจนเป็นรูปธรรม และขาดการมีส่วนของประชาชนในระบบการบริหารจัดการอุทยานแห่งชาติ จึงทำให้ส่งผลเสียโดยตรงต่อการคุ้มครองรักษาทรัพยากรธรรมชาติ ตลอดจนการบริหารจัดการอุทยานแห่งชาติในประเทศไทย
