บทคัดย่อ
สารนิพนธ์นี้มีวัตถุประสงค์ คือ ๑) เพื่อศึกษากระบวนการยุติธรรมในพระวินัยปิฎก ๒) เพื่อศึกษาพัฒนาการกระบวนการยุติธรรมในคณะสงฆ์ไทย
การศึกษา พบว่า พระวินัยที่พระพุทธเจ้าทรงบัญญัติไว้เป็นกรอบแห่งการประพฤติปฏิบัติของพระสงฆ์และวิธีปฏิบัติในการระงับความผิดหรือข้อขัดแย้งที่ เรียกว่า อธิกรณ์และการลงโทษที่เรียกว่านิคหกรรม อธิกรณ์ คือ เรื่องราวที่เกิดขั้นในกระบวนการประพฤติพรหมจรรย์ของภิกษุสงฆ์ที่ต่างสงเคราะห์เกื้อกูลซึ่งกันและกันเพื่อการปฏิบัติสู่เป้าหมายเดียวกันย่อมจะมีสิ่งอันเป็นเหตุให้เกิดอุปสรรคต่อการประพฤติพรหมจรรย์ที่ เรียกว่า อธิกรณ์ ซึ่งมี 4 ประเภท คือ 2. อธิกรณ์ที่สืบเนื่องมาจากการโต้แย้งโต้เถียงกันเรื่องพระธรรมพระวินัย ๒. อธิกรณ์อันสืบเนื่องมาจากการกล่าวหากันด้วยเรื่องละเมิดพระวินัยเพราะไม่ปฏิบัติให้สอดคล้องกับข้อกำหนดที่พระพุทธองค์ทรงบัญญัติไว้ 3. อธิกรณ์อันสืบเนื่องมาจากการยอมรับผิดและการรับโทษตามข้อกำหนดแห่งพระวินัย 4. อธิกรณ์อันสืบเนื่องมาจากการที่พระภิกษุสงฆ์ต้องทำกิจกรรมร่วมกันเพื่อความบริสุทธิ์ของพระภิกษุและคณะสงฆ์ นิคหกรรมเป็นมาตรการทางพระวินัยที่
พระพุทธเจ้าทรงอนุญาตให้สงฆ์ใช้เป็นเครื่องข่ม กำราบ หรือลงโทษแก่พระภิกษุที่ประพฤติผิดพระธรรมวินัยหรือแก่คฤหัสถ์ผู้มีความปรารถนาที่ไม่ดีต่อพระรัตนตรัย โดยทรงวางกฏเกณฑ์การลงโทษตามสมควรดังนี้ 1. ตัชชนียกรรม คือ ทำการตำหนิโทษภิกษุผู้ก่อการทะเลาะวิวาท 2. นิยสกรรม คือ ปรับให้ถือนิสัยใหม่อีก 3. ปัพพาชนียกรรม คือ การขับออกจากหมู่ 4. สารณียกรรม คือ ให้ภิกษุไปขอขมาคฤหัสถ์ 5. อุกเขปนียกรรม คือ ไม่ให้มีสิทธิเสมอกับภิกษุทั้งหลายชั่วคราว 6. สปาปิยสิกากรรม คือ การเพิ่มโทษจากความผิดที่กระทำมา 7. ปกาสนียกรรม คือ การประกาศความผิดของภิกษุ 8. ปัตตนิกุชชนกรรม คือ การคว่ำบาตรไม่ให้รับไทยธรรม 9. พรหมทัณฑกรรม บอกสงฆ์ไม่ให้ว่า กล่าวตักเตือน ปล่อยให้ปรากฏด้วยกรรมของตนเอง
พระพุทธองค์ทรงบัญญัติวิธีการระงับนิคหกรรมไว้ 6 วิธี คือ 1.วิธีการระงับตัชชนียกรรม 2. วิธีการระงับนิยสกรรม 3. วิธีการระงับปัพพาชนียกรรม 4. วิธีการระงับปฎิสารณียกรรม 5. วิธีการระงับอุกเขปนียกรรม 6. วิธีการระงับตัสสปาปิยสิกากรรม นิคหกรรมเป็นกระบวนการพิจารณาคดีความของพระสงฆ์ ซึ่งดำเนินการโดยสงฆ์ เมื่อสงฆ์ผู้ถูกลงนิคหกรรม กลับมาประพฤติชอบมาขอให้สงฆ์ระงับนิคหกรรม สงฆ์จะระงับนิคหกรรมให้ด้วยญัตติจตุตถกรรมวาจา ญัตติทุติกรรมวาจาหรือด้วยวิธีการตามขั้นตอนที่ทรงอนุญาตไว้ กรณีที่พระภิกษุที่ถูกสงฆ์ลงนิคหกรรมแล้วต่อมาลาสิกขาพ้นจากความเป็นพระภิกษุ นิคหกรรมของพระภิกษุรูปนั้นก็เป็นอันระงับ
พัฒนาการกระบวนการยุติธรรมในคณะสงฆ์ไทย เริ่มตั้งแต่สมัยสุโขทัย จนกระทั่งสมัยในปัจจุบัน โดยอาศัยพระราชบัญญัติคณะสงฆ์ พ.ศ.๒๕๐๕ เป็นหลักในการจัดระเบียบการปกครองคณะสงฆ์ เมื่อพระสงฆ์รูปใดรูปหนึ่งละเมิดพระธรรมวินัย ถูกกล่าวโทษและคณะสงฆ์พิจารณาแล้วว่ามีความผิด ก็จะวินิจฉัยลงโทษตามฐานความผิด คือ นิคหกรรมให้สึกหรือไม่ถึงกับให้สึก การใช้กฎนิคหกรรมเป็นมาตรการทางพระวินัย เป็นเครื่องมือสำหรับข่ม กำราบ หรือลงโทษ ผู้ที่ไม่มีศีลธรรมและจริยธรรม โดยการลงโทษตามสมควรแก่ความผิด ให้พระภิกษุประพฤติปฏิบัติในกรอบพระธรรมวินัย และเป็นแบบอย่างที่ดีในการถ่ายทอดพระธรรมคำสอนของพระศาสดาแก่คนในสังคมไทยให้เป็นคนดีมีศีลธรรมและจริยธรรม ทำให้เกิดความสงบเรียบร้อยดีงามในสังคม
