มาตรา 31 ผู้ประกอบกิจการรายใดที่ไม่จ่ายเงินสมทบภายในเวลาที่กฎหมายกำหนดหรือจ่ายไม่ครบตามสัดส่วนจำนวนผู้รับการฝึกอบรมกับจำนวนลูกจ้าง ต้องจ่ายเงินเพิ่มในอัตราร้อยละ 1.5 ต่อเดือนของเงินสมทบที่ยังไม่ได้นำส่งหรือของเงินสมทบที่ยังขาดอยู่ นับแต่วันถัดจากวันที่ต้องนำส่งเงินสมทบ สำหรับเศษของเดือนถ้าถึง

6.2 กรณีผู้ประกอบกิจการจัดให้มีการฝึกอบรมฝีมือแรงงานให้แก่ลูกจ้างของตนครบสัดส่วนร้อยละ 50 ของลูกจ้างทั้งหมด แม้ยื่นแบบแสดงการจ่ายเงินสมทบกองทุนพัฒนาฝีมือแรงงานภายหลังเดือนกุมภาพันธ์ 2550
