นายปริญญา เทวานฤมิตรกุล อาจารย์ประจำภาควิชากฎหมายมหาชน คณะนิติศาสตร์ มหาวิทยาลัยธรรมศาสตร์ ให้ความเห็นว่า การเลือกตั้งเมื่อวันที่ 2 ก.พ.ไม่น่าจะขัดต่อรัฐธรรมนูญทั้ง มาตรา 68 และมาตรา 108 เพราะแม้ว่าตามพระราชกฤษฎีกายุบสภาจะระบุว่า ให้มีวันเลือกตั้งทั่วไปเพียงวันเดียวพร้อมกัน แต่เมื่อมีเหตุจำเป็นที่บางเขตเลือกตั้งยังไม่สามารถรับเลือกตั้งได้ ทำให้ต้องจัดการเลือกตั้งเพิ่มเติม ตรงนี้ต้องถือว่า ยังเป็นส่วนหนึ่งของการเลือกตั้งวันที่ 2 ก.พ.อยู่ จึงไม่จำเป็นต้องออกพระราชกฤษฎีกาเลือกตั้งในส่วนนี้เพิ่มเติมแต่อย่างใด
