บริษัท ให้พนักงานพ้นสภาพการเป็นลูกจ้างเนื่องจากเกษียณอายุก็ต่อเมื่อลูกจ้างมีอายุครบ 60 ปีบริบูรณ์ โดยบริษัทจะให้ลูกจ้างผู้นั้นพ้นจากการเป็นลูกจ้าง ทั้งนี้ให้ถือเอาวันสุดท้ายของเดือนที่ลูกจ้างมีอายุครบ 60 ปีบริบูรณ์เป็นวันเกษียณอายุ กรณีที่จำเป็น บริษัทอาจว่าจ้างพิเศษลูกจ้างที่เกษียณอายุ โดยจะต้องได้รับความยินยอมจากทั้งบริษัทและลูกจ้าง หากบริษัทต้องการยกเลิกสัญญาการจ้างลูกจ้างเกษียณอายุจะต้องมีการบอกกล่าวล่วงหน้าอย่างน้อย 1 งวดการจ่ายค่าจ้าง
