สรุปความเป็นมาและการดำเนินงานเกี่ยวกับพิธีสารมาดริด

กรมทรัพย์สินทางปัญญา มีนโยบายที่จะอำนวยความสะดวกแก่ผู้ประกอบการไทยใน
การขอรับความคุ้มครองสิทธิในเครื่องหมายการค้าในต่างประเทศ โดยกรมฯ ได้ดำเนินการในการเตรียมการให้ประเทศไทยเข้าเป็นภาคีการจดทะเบียนเครื่องหมายการค้าระหว่างประเทศตามพิธีสารมาดริด (Madrid Protocol) ซึ่งจะเป็นอีกช่องทางหนึ่งที่รวดเร็ว และประหยัดค่าใช้จ่ายในการจดทะเบียนเครื่องหมายการค้าในต่างประเทศ ประกอบกับแผนงานการเข้าสู่ประชาคมเศรษฐกิจอาเซียน (ASEAN Economic Community (AEC) Blueprint) มีข้อตกลงให้ประเทศสมาชิกอาเซียนเข้าเป็นภาคีพิธีสารมาดริดภายในปี ค.ศ.๒๐๑๕ (พ.ศ. ๒๕๕๘) อีกด้วย
กรมฯได้ดำเนินการเตรียมการเข้าเป็นภาคีพิธีสารมาดริด ดังนี้
๑. การดำเนินการปีงบประมาณ ๒๕๔๘ กรมฯได้ส่งเสริมและเผยแพร่ความรู้เกี่ยวกับพิธีสารมาดริด การเตรียมความพร้อมและผลกระทบหากประเทศไทยเข้าเป็นภาคี โดยจัดสัมมนา จำนวน ๓ ครั้ง คือ ๑) สัมมนาเชิงปฏิบัติการ“เพิ่มประสิทธิภาพการจดทะเบียนเครื่องหมายการค้า” ๒) สัมมนาเรื่อง “The Madrid Protocol Concerning The International Registration of Marks” โดยผู้เชี่ยวชาญจาก WIPO เป็นผู้บรรยาย ๓) สัมมนาเรื่อง “กติกาใหม่ : ความคุ้มครองเครื่องหมายการค้าในต่างประเทศ”
๒. การดำเนินการปีงบประมาณ ๒๕๔๙ แต่งตั้งคณะทำงานรับผิดชอบเกี่ยวกับการเข้าเป็นภาคีพิธีสารกรุงมาดริด (คำสั่งที่ ๒๒๐/๒๕๔๘ ลว.๑๑ ธ.ค. ๒๕๔๘) เพื่อปฏิบัติหน้าที่ในการจัดทำแผนงานรองรับการเข้าเป็นภาคีพิธีสารกรุงมาดริด ศึกษากฎหมาย ระเบียบต่าง ๆ เตรียมการด้านการบริหารจัดการ และดำเนินการอื่นๆ ที่เกี่ยวข้อง มีการประชุม ๓ ครั้ง มีการจัดทำร่างกฎหมาย ศึกษาขั้นตอนและระเบียบการปฏิบัติในการเข้าเป็นภาคี จัดสัมมนาเชิงวิชาการร่วมกับสภาทนายความเรื่อง ความเป็นไปได้ในการเข้าเป็นภาคีหัวข้อ “Madrid Protocol-Experiences and Perspectives” จัดทำแผนการดำเนินงานเตรียมการรองรับการเข้าเป็นภาคี และเปิดพื้นที่ในเว็บไซต์กรม (www.ipthailand.org) โดยจัดทำความรู้เบื้องต้นและเปิดช่องทางให้แสดงความคิดเห็น
นอกจากนี้ คณะกรรมการพัฒนากฎหมายของกรมฯ ได้มีการยกร่างแก้ไขพระราชบัญญัติเครื่องหมายการค้า พ.ศ.๒๕๓๔ แก้ไขเพิ่มเติมโดยพระราชบัญญัติเครื่องหมายการค้า (ฉบับที่๒) พ.ศ.๒๕๔๓ บางส่วน ให้มีผลถึงการเข้าเป็นภาคีพิธีสารมาดริด โดยได้เสนอต่อสำนักงานเลขาธิการคณะรัฐมนตรี เมื่อวันที่ ๒๗ พฤศจิกายน ๒๕๔๙ และต่อมาเมื่อวันที่ ๒๔ เมษายน ๒๕๕๐ คณะรัฐมนตรีได้อนุมัติหลักการของร่างพระราชบัญญัติดังกล่าวและส่งให้สำนักงานคณะกรรมการกฤษฎีกาพิจารณาต่อไป อย่างไรก็ดี คณะกรรมการกฤษฎีกาในขณะนั้น ได้พิจารณาให้ตัดในส่วนที่เกี่ยวข้องกับการเข้าเป็นภาคีพิธีสารมาดริดออก เนื่องจากว่ากระทรวงพาณิชย์ยังไม่มีนโยบายในการเข้าเป็นภาคีที่ชัดเจน
๓. การดำเนินการปีงบประมาณ ๒๕๕๐ กรมฯ จึงได้จัดจ้างบริษัท อภิสิทธิ์ แอนด์
อัลลายแอนซ์ จำกัด ศึกษาวิเคราะห์ความตกลงระหว่างประเทศด้านเครื่องหมายการค้าโดยจัดทำคำแปลของกฎระเบียบของพิธีสารมาดริดและคู่มือการจดทะเบียนเครื่องหมายการค้าระหว่างประเทศภายใต้ความตกลงกรุงมาดริดและพิธีสารกรุงมาดริด และในปีนี้กรมฯ ได้จัดสัมมนา จำนวน ๑ ครั้ง เรื่อง”ทำอย่างไร จึงจะจดทะเบียนเครื่องหมายการค้าได้ทั่วโลก” รวมถึง มีการศึกษาดูงานระบบมาดริด ณ สำนักงานสิทธิบัตรญี่ปุ่น (Japan Patent Office -JPO) ประเทศญี่ปุ่นด้วย
๔. การดำเนินการปีงบประมาณ ๒๕๕๑ มีการจัดสัมมนา จำนวน ๓ ครั้ง คือ ๑) สัมมนาเชิงปฏิบัติการเพิ่มศักยภาพบุคลากรในเรื่องระบบพิธีสารมาดริดของประเทศสหรัฐอเมริกา โดย

เชิญผู้เชี่ยวชาญจากสำนักงานสิทธิบัตรแห่งสหรัฐอเมริกา (United States Patent and Trademark Office – USPTO) เป็นผู้บรรยาย ๒) สัมมนาเรื่องการเข้าเป็นภาคี MADRID PROTOCOL (WIPO – ASEAN WORKSHOP ON THE MADRID PROTOCOL) เพื่อร่วมสร้างความเข้าใจและรับฟังความคิดเห็นของสมาชิกอาเซียน ๓) ประชุมเชิงปฏิบัติการ “ไทยพร้อมเข้าเป็นภาคีพิธีสารมาดริด...หรือยัง” เพื่อรับฟังความคิดเห็นทั้งภาครัฐและเอกชน และกรมฯ ได้จัดจ้างศูนย์บริการวิชาการแห่งจุฬาลงกรณ์มหาวิทยาลัยศึกษาวิจัยระบบมาดริด โดยศึกษาถึงความสอดคล้องของกฎหมายเครื่องหมายการค้ากับบทบัญญัติของพิธีสารมาดริด ซึ่งคณะวิจัยฯ ได้ทำการยกร่างแก้ไขกฎหมายเครื่องหมายการค้าทุกด้าน ให้ครอบคลุมการเข้าเป็นภาคีพิธีสารมาดริด
๕. การดำเนินการปีงบประมาณ ๒๕๕๒ มีการจัดประชุมรับฟังความคิดเห็นในการที่ประเทศไทยเข้าสู่ระบบการจดทะเบียนเครื่องหมายการค้าตามระบบมาดริด โดยคณะวิจัยฯ และศึกษาดูงานระบบพิธีสารมาดริด จำนวน ๒ ครั้ง คือ ๑) องค์การทรัพย์สินทางปัญญาโลก (WIPO) ประเทศสวิตเซอร์แลนด์ และ ๒) สำนักงานเครื่องหมายการค้าแห่งชาติจีน (Trademark Office-CTMO) กรุงปักกิ่ง ประเทศสาธารณรัฐประชาชนจีน
๖. การดำเนินการปีงบประมาณ ๒๕๕๓ มีดังนี้
๖.๑ ด้านการยกร่างกฎหมาย กรมฯได้มีการแต่งตั้งคณะทำงานพิจารณาเตรียมการเข้าเป็นภาคีพิธีสารมาดริด โดยมีอำนาจหน้าที่ในการดำเนินการกำหนดแผนงาน ขั้นตอนในการเข้าเป็นภาคี ศึกษากฎหมายและระเบียบที่เกี่ยวข้อง และจัดเตรียมการบริหารจัดการเพื่อเตรียมการ
เข้าเป็นภาคีพิธีสารมาดริดและได้จัดการประชุมคณะทำงานฯ รวม ๔ ครั้ง คือ เมื่อวันที่ ๒๒ กุมภาพันธ์ ๒๕๕๓ , วันที่ ๒๒ มีนาคม ๒๕๕๓ , วันที่ ๑๔ พฤษภาคม ๒๕๕๓ และวันที่ ๒๙ กันยายน ๒๕๕๓
๖.๒ ขั้นตอนการเตรียมการเข้าเป็นภาคี กรมฯ ได้มีหนังสือถึงกระทรวงการ
ต่างประเทศ เมื่อวันที่ ๓ กันยายน ๒๕๕๓ เพื่อขอความเห็นเรื่องการเข้าเป็นภาคีพิธีสารมาดริดจะเข้าข่ายเป็นการทำหนังสือสัญญาตามมาตรา ๑๙๐ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.๒๕๕๐ หรือไม่ และหากเป็นเช่นนั้น กรมฯ ควรจะต้องดำเนินการอย่างไรเพื่อให้เป็นไปตามที่กำหนดตามมาตรา ๑๙๐ ตลอดจนขั้นตอนการยื่นพิธีสารและการให้สัตยาบันเป็นภาคีพิธีสารมาดริดต่อองค์การทรัพย์สินทางปัญญาโลก (World Intellectual Property Organization - WIPO)
๖.๓ การเตรียมการด้านอื่น ๆ
