การวิจัยครั้งนี้เป็นการวิจัยเอกสาร มีวัตถุประสงค์เพื่อ 1) ศึกษา รวบรวม กฎหมายที่เกี่ยวข้องกับเด็กต่างด้าวที่ผู้บริหารสถานศึกษาควรรู้ 2) จัดลำดับก่อน – หลังกฎหมายที่เกี่ยวข้องกับเด็กต่างด้าวที่ผู้บริหารสถานศึกษาควรรู้ และ 3) นำเสนอประเด็นหลักที่สำคัญของกฎหมายกฎหมายที่เกี่ยวข้องกับเด็กต่างด้าวที่ผู้บริหารสถานศึกษาควรรู้เพื่อนำไปสู่การปฏิบัติ โดยศึกษาค้นคว้าจากสารบัญญัติของกฎหมายระหว่างประเทศที่ประเทศไทยมีข้อผูกพันและยอมรับ กฎหมายภายในประเทศไทย เอกสารเกี่ยวกับประกาศ ระเบียบ คำสั่งและข้อบังคับของหน่วยงานราชการที่เกี่ยวข้อง วารสารสิ่งพิมพ์ต่างๆ ตั้งแต่ปีพ.ศ. 2475 – ปัจจุบัน และนำข้อมูลที่ได้มาวิเคราะห์เรียบเรียง
ผลการวิจัยมีดังนี้ 1) การศึกษา รวบรวมกฎหมายที่เกี่ยวข้องกับเด็กต่างด้าวที่ผู้บริหารสถานศึกษาควรรู้มีกฎหมายจำนวนทั้งสิ้น 40 ฉบับ แบ่งเป็น (1) กฎหมายระหว่างประเทศ 6 ฉบับ มีแหล่งที่มาได้แก่ จารีตประเพณี 1 ฉบับ สนธิสัญญาที่ประเทศไทยเป็นภาคี 3 ฉบับ และสนธิสัญญาที่ประเทศไทยมิได้เป็นภาคี 2 ฉบับ (2) กฎหมายภายในประเทศไทย 34 ฉบับ มีแหล่งที่มาได้แก่ รัฐธรรมนูญ 11 ฉบับ พระราชบัญญัติ 7 ฉบับ กฎกระทรวง 6 ฉบับ ประกาศกระทรวง 2 ฉบับ ระเบียบกระทรวง 5 ฉบับ และมติคณะรัฐมนตรี 3 ฉบับ 2) การจัดลำดับก่อน – หลังกฎหมายที่เกี่ยวข้องกับเด็กต่างด้าวที่ผู้บริหารสถานศึกษาควรรู้ แบ่งลำดับเป็นช่วง คือ กฎหมายระหว่างประเทศลำดับตามปีที่ประกาศใช้ (ค.ศ. 1948 – 1989 ตรงกับพ.ศ. 2491 – 2532) ส่วนกฎหมายภายในประเทศไทยลำดับเป็นช่วง ได้แก่ (1) พ.ศ. 2475 – 2511 (2) พ.ศ. 2534 – 2538 (3) พ.ศ. 2540 – 2548 (4) พ.ศ. 2550 – ปัจจุบัน 3) ประเด็นหลักที่สำคัญของกฎหมายที่เกี่ยวข้องกับเด็กต่างด้าวที่ผู้บริหารสถานศึกษาควรรู้เพื่อนำไปสู่การปฏิบัติ ได้แก่ (1) ประเด็นที่สอดคล้องสัมพันธ์กันของกฎหมายระหว่างประเทศและกฎหมายภายในประเทศไทย และ (2) ประเด็นเนื้อหาสาระหลักสำคัญเพื่อนำไปสู่การปฏิบัติ
