ถ้าผู้ประกอบการได้รับทราบแล้วไม่รายงานต่อทาง อย. หรือรายงานข้อมูลที่เป็นเท็จ จะมีความผิดตามมาตรา 100 แห่งพระราชบัญญัติเครื่องมือแพทย์ พ.ศ. 2551 ซึ่งมีโทษจำคุก 6 เดือน - 1 ปี และ/หรือมีโทษปรับ 50,000 ถึง 100,000 บาท ต่อกรณี
