บริษัท เขาหลัก พลาซ่า จำกัด โดยนายมนตรี สุวรรณวนิชกิจ และนายทศพล มาลีนนท์ กรรมการผู้มีอำนาจลงนาม สำนักงานตั้งอยู่เลขที่ 18/1 หมู่ที่ 7 ตำบลคึกคัก อำเภอตะกั่วป่า จังหวัดพังงา ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ ผู้ให้เช่า” ฝ่ายหนึ่ง
กับ
นายสุชัย ปราคาน ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ผู้เช่า” อีกฝ่ายหนึ่ง อยู่บ้านเลขที่ 288 หมู่ที่ 1 ตำบลปิล๊อก อำเภอทองผาภูมิจังหวัดกาญจนบุรี

โดยที่
(ก) ผู้ให้เช่าเป็นเจ้าของโครงการเขาหลักพลาซ่า ถนนเพชรเกษม ตำบลคึกคัก อำเภอตะกั่วป่า จังหวัดพังงา ซึ่งมีแผงขายสินค้าให้เช่า ขนาด 2.30 เมตร x 2.30 เมตร ต่อแผง โดยต่อไปนี้เรียกว่า “โครงการ”
(ข) ผู้เช่ามีความประสงค์ที่จะเช่าพื้นที่แผงขายสินค้า แผงล็อคหมายเลข 2, 3 และ 4 ซึ่งตั้งอยู่ที่ ถนนเพชรเกษม หมู่ที่ 7 ตำบลคึกคัก อำเภอตะกั่วป่า จังหวัดพังงา ภายในโครงการเขาหลักพลาซ่า ซึ่งผู้เช่าถือว่าพื้นที่ดังกล่าวเหมาะสมและสมประโยชน์แก่การประกอบการค้าของผู้เช่า และเป็นสาระสำคัญในการเข้าประกอบการค้า ณ สถานที่เช่าของผู้ให้เช่า

คู่สัญญาทั้งสองฝ่ายจึงได้ตกลงทำสัญญาเช่นกัน มีข้อความดังต่อไปนี้

ข้อ 1. สถานที่เช่า
ผู้ให้เช่าตกลงให้เช่าและผู้เช่าตกลงเช่า พื้นที่แผงขายสินค้า แผงล็อคหมายเลข 1, 2, 3 และ 4 ซึ่งตั้งอยู่ภายในโครงการเขาหลักพลาซ่า ถนนเพชรเกษม หมู่ที่ 7 ตำบลคึกคัก อำเภอตะกั่วป่า จังหวัด พังงา ซึ่งต่อไปนี้ในสัญญาจะเรียกว่า “สถานที่เช่า” โดยรายละเอียดสถานที่เช่าเป็นไปตามแผนผังแนบท้ายสัญญา “ เอกสาร แนบท้าย หมายเลข 1 ” และให้ถือเป็นส่วนหนึ่งของสัญญานี้ด้วย

ข้อ 2. วัตถุประสงค์ของการเช่า
ผู้เช่ามีวัตถุประสงค์จะใช้สถานที่เช่าเพื่อให้เป็นสถานที่ประกอบธุรกิจ ร้านตัด เสื้อผ้า (Tailor) เป็นหลัก

ข้อ 3. ระยะเวลาการเช่า และการต่ออายุสัญญา
3.1 ระยะเวลาการเช่าสถานที่เช่าตามสัญญานี้มีกำหนด 1 ปี นับตั้งแต่วันที่ 1 กุมภาพันธ์ 2558 ถึงวันที่ 31 มกราคม 2559
3.2 หากผู้เช่ามีความประสงค์จะเช่าสถานที่เช่าต่อไปหลังจากครบกำหนดระยะเวลาการเช่า ตามข้อ 3.1 ผู้เช่าจะต้องแจ้งความประสงค์ไปยังผู้ให้เช่าเป็นหนังสือก่อนครบกำหนดระยะเวลาการเช่าดังกล่าวไม่น้อยกว่า 1 ( หนึ่ง ) เดือน และผู้ให้เช่าตกลงที่จะให้ผู้เช่าต่อสัญญา โดยคู่สัญญา ตกลงให้เงื่อนไขและข้อกำหนดต่างๆ ที่ระบุไว้ในสัญญานี้มีผลใช้บังคับต่อไปด้วย เว้นแต่ ระยะเวลาสัญญาใหม่ และ อัตราค่าเช่าซึ่งผู้ให้เช่าและผู้เช่าจะตกลงกันในภายหลัง
