บทที่ 5
กฎหมายควบคุมอาคาร
วัตถุประสงค์
กฎหมายควบคุมอาคาร มีวัตถุประสงค์เพื่อควบคุมการก่อสร้างอาคารให้มี
ความมั่นคง แข็งแรงและปลอดภัย มีความเป็นระเบียบเรียบร้อย สวยงามและมีการ
จัดการด้านการรักษา คุณภาพ สิ่งแวดล้อม เช่น การจัดให้มีระบบบำบัดน้ำเสียก่อน
ปล่อยลงสู่ทางระบายน้ำสาธารณะ เป็นต้น
สาระสำคัญที่เกี่ยวข้องกับวิชาชีพวิศวกรรม
กฎหมายควบคุมอาคารที่เกี่ยวข้องกับวิศวกร ประกอบด้วย
พระราชบัญญัติควบคุมอาคาร พ.ศ. 2522, พระราชบัญญัติควบคุมอาคาร
(ฉบับที่ 2) พ.ศ. 2535 และพระราชบัญญัติควบคุมอาคาร (ฉบับที่ 3) พ.ศ. 2543 ซึ่ง
เป็นกฎหมายหลักหรือกฎหมายแม่บท
กฎกระทรวงซึ่งเป็นกฎหมายที่กำหนดรายละเอียด เช่น รายละเอียดวิธีการ
ปฏิบัติในการขออนุญาต รายละเอียดข้อกำหนดงานทางด้านวิศวกรรมและ
สถาปัตยกรรม เป็นต้น
ข้อบัญญัติท้องถิ่นซึ่งเป็นกฎหมายที่กำหนดรายละเอียด เนื่องจากมีความ
จำเป็นหรือ มีเหตุผลพิเศษเฉพาะท้องถิ่น เช่น ข้อบัญญัติกรุงเทพมหานคร เทศบัญญัติ
ของเทศบาล ข้อบังคับองค์การบริหารส่วนตำบลขององค์การบริหารส่วนตำบล เป็นต้น
ซึ่งแต่ละท้องถิ่นจะเป็นผู้พิจารณาดำเนินการออกข้อบัญญัติท้องถิ่นนี้เองได้ในกรณี
ดังนี้
• กำหนดรายละเอียดเพิ่มเติมจากกฎกระทรวง
• ออกขัดหรือแย้งกับกฎกระทรวงในกรณีที่มีความจำเป็นหรือเหตุผลพิเศษ
เฉพาะท้องถิ่น (มาตรา 10)
ประกาศกระทรวงมหาดไทยซึ่งเป็นเรื่องเฉพาะสำหรับกำหนดบริเวณห้าม
ก่อสร้างอาคารบางชนิดหรือบางประเภท มีอายุใช้บังคับเพียง 1 ปี นับจากวัน
ประกาศใช้ในราชกิจจานุเบกษา (มาตรา 13)
นอกจากนี้กฎหมายควบคุมอาคารยังมีความเกี่ยวข้องกับกฎหมายอื่นอีกหลาย
ฉบับ เช่น กฎหมายผังเมือง กฎหมายวิศวกร กฎหมายสิ่งแวดล้อม เป็นต้น การใช้
กฎหมายอาคาร จึงจะดูแลเฉพาะกฎหมายแม่บทอย่างเดียวไม่ได้ แต่ต้องศึกษา
กฎหมายรองและกฎหมายอื่น ที่เกี่ยวข้องควบคู่ไปด้วย

พื้นที่บังคับใช้
กฎหมายควบคุมอาคารเป็นกฎหมายที่โดยทั่วไปจะใช้บังคับในท้องที่ที่มีความ
เจริญ มีการก่อสร้างอาคารค่อนข้างหนาแน่น หากท้องที่ใดต้องการควบคุมการก่อสร้าง
อาคารให้มีความสวยงามเป็นระเบียบเรียบร้อยมีความมั่นคงแข็งแรงและปลอดภัย
จะต้องประกาศพระราชกฤษฎีกาบังคับใช้พระราชบัญญัติควบคุมอาคาร พ.ศ. 2522
ในท้องที่นั้น ๆ เสียก่อน (มาตรา 2)
เมื่อมีการประกาศพระราชกฤษฎีกาให้ใช้พระราชบัญญัติควบคุมอาคาร พ.ศ.
2522 ในท้องที่ใดก็ตาม การก่อสร้าง ดัดแปลง รื้อถอน เคลื่อนย้าย ใช้หรือเปลี่ยนการ
ใช้อาคารในท้องที่ที่นั้นต้องได้รับใบอนุญาตให้ก่อสร้าง ฯลฯ อาคารหรือแจ้งต่อเจ้า
พนักงานท้องถิ่นและได้ใบรับแจ้งก่อนจึงจะเริ่มดำเนินการก่อสร้างอาคารได้ ท้องที่ที่ได้

คำจำกัดความที่สำคัญในกฎหมายควบคุมอาคาร

หรือน้ำหนักรวมทั้งโครงสร้างเกินสิบกิโลกรัม หรือ
• ที่ติดหรือตั้งห่างจากที่สาธารณะ ซึ่งเมื่อวัดในทางราบแล้วมี
ระยะห่างจากที่สาธารณะน้อยกว่าความสูงของป้ายนั้นเมื่อวัดจาก
พื้นดิน และต้องมีขนาด พื้นที่ หรือน้ำหนักอยู่ใน 4 ลักษณะ คือ
- ขนาดความกว้างของป้ายเกิน 50 เซนติเมตร หรือ

- ยาวเกิน 1 เมตร หรือ
- เนื้อที่ของป้ายเกิน 5,000 ตารางเซนติเมตร หรือ
- มีน้ำหนักของป้ายหรือสิ่งที่สร้างขึ้นสำหรับติดหรือตั้งป้ายอย่าง
ใดอย่างหนึ่ง หรือ ทั้งสองอย่างรวมกันเกิน 10 กิโลกรัม
4. พื้นที่หรือสิ่งที่สร้างขึ้นเพื่อใช้เป็นที่จอดรถ ที่กลับรถ และทางเข้า
ออกของรถ สำหรับอาคารดังต่อไปนี้
