ประกาศให้ทราบนะคะ บทลงโทษมีผลบังคับใช้ ตั้งแต่ 20 มีนาคม 2559 (เดือนหน้านี้แล้วนะคะ) ฝากคนไทยที่รู้จัก หรือร่วมงานกับชาวต่างชาติ ให้ช่วยเตือนด้วยนะคะ

จำง่ายๆ มีแค่ 2 กรณีเท่านั้นคือ

1.กรณีถูกจับกุม ( ตร.ตาม สน. หรือ ท้องที่ต่างๆจับ หรือ ตร.ตม. จับ) แม้จะอยู่เกิน 1 วัน ห้ามเข้าไทย 5 ปีเลยนะคะ

2.กรณีมอบตัว ( มาจ่ายค่าปรับตามด่านที่จะออก หรือ ไปติดต่อ ที่ออฟฟิต ตม.จังหวัดต่างๆ หรือแจ้งวัฒนะ) ถ้าอยู่เกินไม่ถึง 90 วัน ค่าปรับยังเป็นอัตราเดิมคือวันละ 500 บาท แต่สูงสุดไม่เกิน 20,000 บาท .. คุณอยู่เกินได้ไม่เกิน 90 วัน จะยังไม่ติดแบล็คลิสห้ามเข้าประเทศ แต่ถ้าเกินกว่านั้น ติดทุกรายค่ะ แถมยังต้องจ่ายค่าปรับเหมือนเดิมนะ

ส่วนนี้เป็นกรณีศึกษา ให้อ่านไว้ก่อนเผื่อเจอสถานการณ์จริง

1. Overstayed ในที่นี้ หมายถึง คนต่างด้าวทุกคนที่ใช้หนังสือเดินทางเข้าประเทศไทย และ ได้รับอนุญาตให้อยู่ในไทย (อาจจะใช้วีซ่าเข้ามา หรือ ไม่ใช้ก็ได้นะจ๊ะ)
1.1 เข้ามาไทย .. ตม.ขาเข้า ตีตราให้อยู่ 30 วัน แต่อยุ่เป็น 35 วัน แปลว่า อยู่เกิน 5 วัน ( 5 วันยังไม่ติดแบลคลิส แต่ถ้าโดนจับ ..ติดเลยทันที)
1.2 เข้ามาไทย .. ตม.ขาเข้าตีเข้าให้อยู่..มายื่นขออยู่ต่อที่ตม.จังหวัด..ตีให้ 1 ปี แล้วอยู่เกิน มาต่อช้า .. จ่ายค่าปรับ และถ้าเกิน 90 วันอีก ก็โดนแบลกลิส ห้ามเข้าไทย 1 ปีนะจ๊ะ แต่ถ้าเดินไปเดินมาโดนจับ โดนห้ามเข้าไทย 5 ปีแทน
1.3 เข้ามาไทย..ตม.ขาเข้าตีเข้าให้อยู่..มายื่นขออยู่ต่อที่ ตม.จังหวัด..ตีให้อยู่ เพื่อทำงาน หรือเรียน หรืออะไรก็ตาม แล้วผิดเงื่อนไข เช่น ย้ายงาน เปลี่ยนงาน เปลี่ยนโรงงาน หย่าร้าง ..ถือว่า การอนุญาตนั้นสิ้นสุด ถ้าไม่มายื่นขออยู่ต่อพร้อมเอกสารชุดใหม่ ก็ต้องเดินทางออกนอกประเทศนะ ไม่งั้นเรียกว่า อยู่เกินกำหนดอนุญาตเหมือนกัน

2. คนต่างชาติที่ทำงานในไทยโดยมีใบอนุญาตทำงาน ให้ทำงานกับบริษัท A แต่ต่อมา ย้ายงานไป บริษัท B แต่มีช่องว่างของวันที่อยู่เกิน คือ วันที่ ตม.อนุญาตให้คุณทำงานกับ บริษัท A นั้น หากออกจากงานวันไหน วันถัดไปคือวันที่การอนุญาตจาก ตม.ถือว่าสิ้นสุด หากคุณไม่ยื่นเรื่องขออยู่ต่ออีกวันถัดไป คุณก็จะกลายเป็นคนที่อยู่เกินทันที ... ให้ศึกษาและปรึกษา ตม. ดีๆนะคะ

3. คนไทยที่ถือหนังสือเดินทาง 2 เล่ม หากใช้เล่มต่างชาติเข้ามาในไทยแล้วอยู่เกิน แต่ขาออกจะใช้เล่มไทยออกนั้น อย่าลืมนะคะ ว่าขาเข้า คุณใช้สิทธิเป็นคนต่างชาติ หากคุณอยู่เกินกำหนดอนุญาต ในฐานข้อมูลจะยังถูกบันทึกไว้ บทลงโทษคือ เราจะขึ้นแบลคลิสไว้กับหนังสือเดินทางต่างชาติเล่มนั้น แต่คุณยังเข้าประเทศไทยได้ หากคุณใช้หนังสือเดินทางไทยเข้าไทย (ยกเว้นกรณีสละสัญชาติแล้วนะคะ ที่คุณจะเหลือสัญชาติเดียวคือสัญชาติอื่น) โปรดใช้พาสปอร์ตอย่างระมัดระวัง
