(1) ความตกลงพหุภาคีอาเซียนว่าด้วยการเปิดเสรีบริการขนส่งสินค้าทางอากาศ (ASEAN Multilateral Agreement on the Full Liberalisation of Air Freight Services: MAFLAFS)
ให้สิทธิแก่ประเทศสมาชิกในการบินผ่านน่านฟ้าของประเทศสมาชิกอื่น มีสิทธิลงจอดในกรณีที่ไม่ใช่เพื่อการจราจร และสิทธิอื่นๆ ที่กำหนดไว้ แต่ละประเทศสมาชิกมีสิทธิกำหนดให้สายการบินที่จะเป็นผู้ให้บริการขนส่งทางอากาศระหว่างประเทศซึ่งจะมีจำนวนเท่าใดก็ได้ นอกจากนี้ ยังได้กำหนดมาตรการต่างๆ เช่น การออกและการเพิกถอนใบอนุญาตแก่สายการบินผู้ให้บริการ ความปลอดภัย การรักษาความปลอดภัย ภาษีศุลกากร และการระงับข้อพิพาท เป็นต้น ซึ่งความตกลงนี้มีพิธีสารแนบท้าย 2 ฉบับ คือ
พิธีสารที่ 1 ว่าด้วยสิทธิรับขนการจราจรเสรีภาพที่ สาม สี่ และห้าอย่างไม่จำกัด ระหว่างจุดที่กำหนดต่างๆ ในอาเซียน ทั้งนี้ แต่ละประเทศจะกำหนดจุดไว้ ซึ่งไทย ระบุ กรุงเทพฯ เชียงใหม่ หาดใหญ่ ขอนแก่น ภูเก็ต อู่ตะเภา และอุบลราชธานี
พิธีสารที่ 2 ว่าด้วยสิทธิรับขนการจราจรเสรีภาพที่ สาม สี่ และห้าอย่างไม่จำกัด ระหว่างทุกจุดที่เป็นท่าอากาศยานระหว่างประเทศในอาเซียน
อนึ่ง สิทธิในการเดินอากาศแบบประจำระหว่างประเทศ เรียกว่า เสรีภาพทางอากาศ ซึ่งมีอยู่ 9 ประเภท แต่มีเพียงเสรีภาพที่ 1 – 5 ที่ได้มีการรับรองอย่างเป็นทางการ โดยมีความหมาย ดังนี้ เสรีภาพที่ 1 (First Freedom) คือ สิทธิที่ประเทศหนึ่งให้แก่ประเทศอื่นในการบินผ่านน่านฟ้าเหนืออาณาเขตของตนโดยไม่มีการแวะลงจอด
เสรีภาพที่ 2 (Second Freedom) คือ สิทธิที่ประเทศหนึ่งให้แก่ประเทศอื่นในการให้บริการการบินระหว่างประเทศ ที่จะแวะลงจอดในเขตประเทศตนซึ่งไม่ได้มีวัตถุประสงค์เพื่อการค้า
เสรีภาพที่ 3 (Third Freedom) คือ สิทธิที่ประเทศหนึ่งให้แก่อีกประเทศหนึ่งในการให้บริการการบินระหว่างประเทศที่จะลงจอดภายในเขตประเทศของตน ซึ่งเดินทางมาจากประเทศของสายการบินผู้ขนส่ง
เสรีภาพที่ 4 (Fourth Freedom) คือ สิทธิที่ประเทศหนึ่งให้แก่อีกประเทศหนึ่งในการให้บริการการบินระหว่างประเทศที่จะนำเครื่องบินขึ้นในเขตประเทศตนเพื่อการจราจรที่ไปยังประเทศของสายการบินผู้ขนส่ง
เสรีภาพที่ 5 (Fifth Freedom) คือ สิทธิที่ประเทศหนึ่งให้แก่อีกประเทศหนึ่งในการให้บริการการบินระหว่างประเทศที่จะลงจอดและนำเครื่องบินขึ้น ในอาณาเขตประเทศตนเพื่อการจราจรที่มาจากหรือมุ่งไปยังประเทศที่สาม ซึ่งการจราจรที่มาจากหรือไปยังประเทศที่สาม
