สังคมสมัยอยุธยาได้มีความเปลี่ยนแปลง

สังคมสมัยอยุธยาได้มีความเปลี่ยนแปลงแตกต่างไปจากสังคมในปัจจุบันอย่างมาก ทั้งนี้ก็เพราะการปกครองในสมัยนั้นได้เปลี่ยนฐานะไป นั่นคือ พระมหากษัตริย์ได้เปลี่ยนฐานะจากมนุษย์ราชในสมัยสุโขทัยเป็นเทวราชขึ้นในสมัยอยุธยา เปลี่ยนจากฐานะความเป็น "พ่อขุน" มาเป็น "เจ้าชีวิต" ของประชาชนซึ่งเป็นผลให้ระบบและสถาบันทางการปกครองต่างๆ แตกต่างไปจากสังคมในปัจจุบันอย่างมาก
ซึงในสมัยอยุธยาสมัยนั้นได้การปกครองแบบการปกครองระบอบสมบูรณาญาสิทธิราชย์กล่าวคือพระมหากษัตริย์ทรงเป็นสมมติเทพ ทรงมีอำนาจสูงสุด และเป็นเจ้าชีวิตของประชาชนจึงถือกำเนิด ทาส ทาส หมายถึง บุคคลซึ่งถูกนับสิทธิเสมือนสิ่งของของผู้อื่น ไม่มีอิสระในการดำรงชีวิต และมีหน้าที่รับใช้ผู้อื่นโดยมิได้รับการตอบแทนจากเจ้าของ (นายทาส) เช่น การรับใช้ทางด้านแรงงาน และหากไม่เชื่อฟังคำสั่ง อาจถูกลงโทษได้ตามแต่นายทาสจะกำหนด ยกเว้นเป็นการกระทำอันทำให้ถึงแก่ความตาย
โดยเปรียบเสมือนการแบ่งชนชั้น ซึ่งเป็นที่ยอมรับกันว่า สังคมอยุธยามีทาสไว้ใช้ ทาสเป็นชนชั้นอีกชนชั้นหนึ่งของสังคมสมัยอยุธยาและกฎหมายอยุธยาก็ได้ยอมรับการมีทาส จึงได้มีเกิด ทาสขึ้น โดยมีบทบัญญัติเกี่ยวกับทาสไว้มากมายและได้แบ่งประเภทของทาสไว้ ๗ พวกด้วยกันคือ

๒. ทาสเกิดในเรือนเบี้ยสินไถ่
๓. ทาสได้มาแต่บิดามารดา
๔. ทาสท่านให้
๕. ทาสอันได้ช่วยเหลือในยามโทษทัณฑ์
๖. ทาสอันได้เลี้ยงมาเมื่อเกิดทุพภิกขภัย
๗. ทาสอันได้ด้วยเชลย
โดยทาสในสมัยนั้นถูกจำกัดสิทธิต่างๆ และไม่มีเสรีภาพในการดำรงชีวิตซึ่งขัดแย้งกันกับกฏหมายสมัยใหม่ที่ทุกๆคนมีสิทธิและเสรีภาพเท่าเทียมกันสิทธิที่มนุษย์ทุกคนมีความเท่าเทียมกัน มีศักดิ์ศรีของความเป็นมนุษย์ สิทธิ เสรีภาพ และความเสมอภาคของบุคคลที่ได้รับการรับรอง ทั้งความคิดและการกระทำที่ไม่มีการล่วงละเมิดได้ไมว่าจะเป็นการฆ่าผู้อื่น การทำร้ายร่างกาย การขโมยของผู้อื่น โดยการกระทำข้างต้นได้รับการ คุ้มครองตามรัฐธรรมนูญแห่งราชอาณาจักรไทย เช่น ประมวลกฎหมายแพ่งและพาณิชย์ ประมวลกฎหมายอาญา
​จากที่กล่าวมานี้จะเห็นว่า ทาสในสมัยอยุธยานั้น เป็นทาสที่ถูกกฎหมายบัญญัติให้ เป็นทาสที่มีสภาพเป็นมนุษย์และเป็นพลเมืองของชาติอย่างสมบูรณ์ ฉะนั้นทาสในสมัยอยุธยาจึงไม่ได้มีความสมัครใจแต่อย่างใดในการจะเป็นทาสเพราะมนุษย์ทุกคนต่างต้องการเสรีภาพในการใช้ชีวิตและด้านต่างๆ แต่สมัยอยุธยานั้นไม่มีการให้สิทธิแก่ทาสแม้แต่อย่างใจถึงจำให้จำใจต้องเป็นทาสเพราะอย่างน้อยก็มีข้าวกิน มีที่อยู่อาศัยโดยไม่เดือดร้อน ดังนั้นจึงกล่าวได้ว่าทาสทุกๆคนนั้นไม่มีความสมัครใจ แต่ต้องจำใจเพราะถ้าไม่เป็นทาสแล้วก็เปรียบเสมือนว่าเป็นกบฏ แต่ต่อ พระบาทสมเด็จพระจุลจอมเกล้าเจ้าอยู่หัวทรงประกาศ "พระราชบัญญัติพิกัดเกษียณลูกทาสลูกไทย" เมื่อวันที่ 21 สิงหาคม พ.ศ. 2417
ความไม่เหมาะสมล้าสมัยของกฎหมายไทยเดิม เช่น กฎหมายสมัยใหม่ถือว่าทุกคนเกิดมาเท่าเทียมกัน หรือเสมอภาคกัน แต่สังคมไทยในเวลานั้นยังมีทาสอยู่ การปฏิบัติต่อทาสนั้นถือว่าทาสเป็นทรัพย์สินของมูลนายหรือเจ้าของทาส หรือในเรื่องความคิดเกี่ยวกับกฎหมายอาญาและ วิธีพิจารณาความ ตามหลักกฎหมายใหม่ ถือว่าการที่เจ้าหน้าที่ของรัฐจะจับกุมลงโทษบุคคลใดได้ จะต้องปรากฏว่าการกระทำนั้นมีกฎหมายบัญญัติไว้ชัดแจ้งว่าเป็นความผิดและกำหนดโทษไว้ การพิจารณาคดีอาญาก็ต้องเป็นไปโดยคำนึงถึงศักดิ์ศรีของความเป็นมนุษย์ จะใช้วิธีจารีตนครบาลเป็นการทรมานร่างกายข่มขู่ให้รับสารภาพไม่ได้ ขณะที่สังคมไทยในเวลานั้นยังมีวิธีการปฏิบัติต่อผู้กระทำผิดแบบเดิม การลงโทษที่มีลักษณะรุนแรงและการพิจารณาคดีโดยใช้จารีตนครบาล เช่น บีบขมับ ทับเล็บ มะพร้าวห้าวยัดปาก ตัดคอ ยังคงมีอยู่ เรื่องเหล่านี้ทำให้ชาวต่างชาติถือเป็นข้อรังเกียจและเป็นข้ออ้างไม่ขึ้นศาลไทยจึงทำให้ประเทศไทยในสมัยนั้นไม่เป็นที่ยอมรับของต่างชาติ
ดังนั้น ในสมัยอยุธยาที่มีทาสนั้นจึงไม่เป็นที่ยอมรับของต่างชาติ จึงทำให้ต่างชาติมองว่าประเทศไทยสมัยนั้นล้าสมัยอีกอีกทั้งการเป็นทาสในสมัยนั้นต่างไม่เป็นที่สมัครแต่จำใจจะต้องเป็น โดยที่การเป็นทาสต่างโดนจำกัดสิทธิและเสรีภาพต่างๆ ตามที่ควรจะได้รับ เพราะมนุษย์ทุกคนต่างมีสิทธิและเสรีภาพที่เท่าเทียมกัน
