ด้วยเหตุดังกล่าว ทำให้ บริษัท เฮลโกมอนด์ จำกัด หรือผู้เช่า มีเหตุขัดข้องไม่สามารถทราบได้ว่าจะทำการชำระค่าเช่าตามสัญญาเช่าฉบับนี้ให้กับบุคคลใดจึงจะถูกต้องตามกฎหมาย ทั้งนี้ บริษัท เฮลโกมอนด์ จำกัด หรือผู้เช่า พร้อมจะชำระค่าเช่าดังกล่าวให้กับผู้ให้เช่าตามกำหนดของสัญญาเช่าแล้ว แต่กรณีมีเหตุขัดข้องดังกล่าว ซึ่งมิได้เป็นความผิดของผู้เช่า ดังนั้น เพื่อมิให้ฝ่ายผู้เช่าตกเป็นฝ่ายผิดสัญญาในการชำระค่าเช่าตามกำหนดเวลาตามสัญญา ผู้เช่ามีความจำเป็นต้องชำระค่าเช่าโดยใช้วิธีการวางทรัพย์ กับสำนักงานวางทรัพย์ กรมบังคับคดี โดยได้ทำการวางทรัพย์เป็นแคชเชียร์เช็ค จำนวนเงิน 3,360,000 (สามล้านสามแสนหกหมื่นบาทถ้วน)โดยสั่งจ่ายสำนักงานบังคับคดีแพ่ง กรุงเทพมหานคร 2 ลงวันที่
