วันเกิดเหตุฝนตกไม่มากและลมพัดไม่แรง การที่ต้นจามจุรีริมทางหลวงล้มทับผู้ตายขณะขับรถจักรยานยนต์ไปตามทางหลวงจนเป็นเหตุให้ผู้ตายถึงแก่ความตายมิใช่เกิดจากเหตุสุดวิสัย แต่เป็นเพราะความบกพร่องของกรมทางหลวงจำเลยที่ไม่โค่นเหรือปล่อยปละละเลยไม่สั่งเจ้าหน้าที่ของจำเลยไปโค่นต้นจามจุรีที่มีสภาพผุกลวงเพื่อป้องกันมิให้เกิดความเสียหายแก่ผู้อื่น อันเป็นการกระทำละเมิดของจำเลย จำเลยจึงต้องรับผิดต่อโจทก์
